Warranty Coverage

This limited warranty is provided by Glowble Lighting, LLC (“Seller”) to you as the original purchaser of the LED Luminaire that is identified on Seller’s invoice reflecting the original purchase (the “Product”).  The Seller warrants the Product, when delivered in new condition from Seller will be free of defects in material and workmanship in normal use, for a period of ten (10) years from the date of the invoice and shipping.  This limited warranty extends only to Seller’s original purchaser and only if Purchaser notifies Seller of the defective products within thirty (30) days after the first discovery of any alleged defective condition of the LED Luminaire.

The warranty is related to the fixture housing, finish, and light engine.  Glowble Lighting will repair or replace, at its own option, any warranted product returned to it that it determines to be defective.

This limited warranty does not include installation or removal, nor does it extend to the LED drivers, which are warranted for seven (7) years.

Seller will consider the Product defective if it fails to operate in accordance with the performance specifications set forth in the documentation accompanying the Seller Product or on the published Seller specification sheets.

Seller or its designated agent shall have the right to inspect any Seller Product prior to executing any remedy as stated within this Limited Warranty.  The original purchaser shall be responsible for safeguarding and holding the alleged defective Product for Seller’s inspections.  Seller shall have the option in its sole discretion to (i) instruct the Purchaser to ship the Product to Seller at Purchaser’s expense (ii) to have the designated agent inspect the Product at the original purchaser’s premises; or (iii) require the original purchaser to supply Seller digital photographs of the defective Product.

This limited warranty, without limitation, does not apply to and specifically excludes claims or damage to the Seller’s Product resulting from any cause other than defective materials or workmanship including, but not limited to, (i) incorrect or improper handling, storage or installation of Seller’s Product, (ii) failure to follow the operating, maintenance or any instructions prescribed by Seller or applicable code, (iii) the failure to abide by applicable electrical codes, (iv) fault or negligence of the Purchaser, (v) misuse, abuse, negligence, accident or use of the Seller’s Product beyond the product specifications, (vi) connection of Seller’s Product to third party sensors, dimmers, emergency packs, batteries, signal lines or other devices, (vii) alteration or repair of the Seller’s Product by anyone but Seller or its authorized representatives, (viii) acts of God or accident, (ix) improper maintenance or service of Seller’s product, (x) abnormal site or usage conditions, including, but not limited to, animal or insect activity, power surges; improper power supply; electrical current fluctuations, including under/over voltage or under/over current; corrosive environment installations; excessive ambient temperatures (over 65C); induced vibration; harmonic oscillation, or resonance associated with movement of air currents around the Seller’s Product.

This limited warranty is exclusive and is given and accepted in lieu of any and all other warranties, whether expressed or implied, including, but not limited to, any warranty against any infringement and any implied warranties of merchantability or fitness for particular purpose.  In no event shall Seller have any liability for incidental, consequential, indirect, special or punitive damages claimed by the original purchaser, consumer or other party in connection with Seller’s Product.

Purchaser’s sole and exclusive remedy for breach of this limited warranty with respect to any Seller product which is defective shall be limited to the remedies set forth hereinabove.  No modifications of this limited warranty shall be in effect unless issued in writing and signed by Seller’s authorized factory representative.  If any provision of this limited warranty is determined to be unenforceable, the remainder shall remain in full force and effect.
